Introduction

This Intellectual Property Policy is laid out to clearly explain how to report intellectual property infringement on Schemon services, mainly the Schemon portal. Schemon takes Intellectual Property infringement seriously and as a result implements this Policy.

Schemon provides its customers a platform that is used by service providers to provide services to their customers, which are called service provider customers. Service providers provide services in a closed environment in which only its own service provider customers can access. During these actions, service providers and / or service provider customers are able to share / post data, which may infringe on intellectual property.

Due to the closed nature of the environment, intellectual property infringements are hard to detect and practically can only be detected by service provider customers themselves. Schemon does not eavesdrop on service provider content, thus it has no means to analyse intellectual property infringements and can only act on takedown notices.

This Policy covers how Schemon addresses takedown notices from intellectual property rights holders with respect to the content hosted on the Schemon portal.

Definitions

Schemon,Inc. is referred in this document as “Schemon”. It also implies Schemon when “we”, “us”, and “ours”is written in this document.

Schemon provides certain services over the Internet. These services, which are called “services” in this document are:

The person accessing services, you, is referred as the“visitor”. It is also implied when “you” and “your” is written in this document. You are a visitor if your access is limited with the website and blog. If you are accessing the portal by signing in, you are using the Schemon portal, referred as “user” in this document.

Intellectual property is referred as “IP” or “intellectual property” in this document.

Schemon customers which are users with the aim of providing services on the portal are called “service providers”. These service providers provide services to their customers who are called “service provider customers”.

Reporting IP Infringement Claims

The Digital Millennium Copyright Act (DMCA) requires Schemon to remove or disable access to potentially infringing content upon receipt of a notice that meets certain requirements.

Section 512 of the DMCA outlines the requirements for reporting a copyright violation for copyright holders, as well as requirements for submitting a Counter Notice by an affected party.

You may request removal of any IP infringent material by sending the information detailed in the “Required Information” section below to Schemon's Designated Agent via email to info@schemon.comor via mail to Schemon, Inc., Christiana Corporate Business Center, 200 Continental Dr, Suite 401, PMB 1578, Newark, DE 19713, USA.

Required Information

Infringement claims need to be sent with the following information to be processed correctly:

  1. A description of the IP,
  2. Location of the IP on the Schemon portal,
  3. Location of the original IP,
  4. Your address, telephone number and email address,
  5. The following statement by you: “I have a good faith belief that use of the disputed material in the manner complained of is not authorized by the copyright or trademark owner, its agent or the law.”
  6. The following statement by you: “I certify under penalty of perjury that the information in this complaint is accurate and that I am the copyright or trademark owner or I am authorized to act on the copyright or trademark owner's behalf.”
  7. Signature of the owner of the IP or anyone authorized to act on behalf

Copyright laws of the United States require you to consider copyright defenses, limitations or exceptions, such as the fair use doctrine, before sending a notice. If you are not sure whether the material infringes your Intellectual Property or whether the fair use doctrine applies, we suggest you contact an attorney.

Please be aware that knowingly submitting a false or misleading copyright takedown notice is illegal, and you could be held liable and may have to pay damages as a result. Schemon reserves the right to seek damages from anyone who submits a notification of claimed infringement in violation of the law (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Please be aware that acopy of your notice will be sent to the party responsible for the content you are reporting.

Counter Notification Procedures

You may file a counter notification by submitting a written notification to Schemon. Pursuant to the DMCA, a Counter Notice must be in writing and include the following information:

  1. Identification of the IP that has been removed / disabled,
  2. The location of the removed / disabled content before removal,
  3. Your address, telephone number and email address,
  4. The following statement by you: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.",
  5. The following statement by you if you operate in the USA: “I consent to the jurisdiction of the federal district court located within the judicial district in which I reside.”,
  6. The following statement by you if you operate outside of the USA: “I consent to the jurisdiction of the United States District Court for the District of Delaware, and I will accept service of process from the person (or an agent of that person) who provided Schemon with the complaint at issue.”,
  7. Signature of the owner of the IP or anyone authorized to act on behalf

Please be aware that knowingly submitting a false or misleading Counter Notice is illegal and you could be held liable and may haveto pay damages as a result. Schemon reserves the right to seek damages from anyone who submits a Counter Notice in violation of thelaw (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Repeat Infringement

If Schemon detects that a user is repeatedly infringing IP, Schemon may limit access to services and / or terminate any users that infringe any intellectual property rights of others.

Updates to This Intellectual Property Policy

This Intellectual Property Policy might be updated from time to time. The date at the top of this Intellectual Property Policy indicates when it was last updated. Please re-visit this Intellectual Property Policy regularly to stay informed about our security measures.
